    Never mind the fact that there’s nothing stopping business owners from finding legal ways to discriminate against the people they don’t like. I see it all the time — people who should have been fired years ago for piss-poor job performance getting break after break as they’re the favorite pets of management, yet others not in the “friends” network get the hammer dropped on them for the slightest infraction.

    The worst example of this that I’ve seen was at an Indian casino where I worked about five years ago, where enrolled tribal members could show up drunk and drink on the job for years, and still keep their jobs. One of the tribal guys who wasn’t a drunk said to me, “You don’t get it, Mike. I do what I want here. If I want to do my job, I do. If not . . . oh, well.”

    This same casino had a sign posted in the lobby of the HR suite stating that they could and would give first choice of available positions to enrolled tribal members, as per a 1992 amendment to the National Indian Gaming Regulatory Act of 1987.

    This pales with the double standard from the New Mexico State Legislature, which guarantees that it will limit competition against the tribes from non-Indian gaming ventures, in exchange for the Legislature getting a cut from the tribes’ take from the slot machines.
